Terms of Service

Momentum SaaS is a web-based software-as-a-service platform that provides momentum scoring and analysis tools for publicly traded securities. The service calculates and displays statistical momentum indicators based on historical price data. Momentum SaaS is an informational and educational tool. It does not provide financial advice, investment recommendations, or solicitations to buy, sell, or hold any security. Momentum scores are statistical indicators derived from historical price trends and do not predict future performance. You should not rely on Momentum SaaS as a basis for investment decisions.

To use Momentum SaaS, you must create an account by providing a valid email address and authenticating through our identity provider. You must be at least 16 years old to create an account and use the service, in compliance with French data protection law (Article 7-1, Loi Informatique et Libertes). You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access to your account.

Momentum SaaS offers both free and paid subscription plans. Paid subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase. All payments are processed by Lemon Squeezy, an external payment processor. By subscribing to a paid plan, you also agree to Lemon Squeezy's terms of service and privacy policy. Momentum SaaS does not store your payment card details; all payment information is handled directly by Lemon Squeezy. Prices are displayed inclusive of applicable taxes. You may manage your subscription, update payment methods, or cancel your subscription through the Lemon Squeezy customer portal accessible from your account settings. Refunds are handled in accordance with Lemon Squeezy's refund policy and applicable consumer protection laws.

Momentum SaaS may offer a free trial period for paid subscription plans. During the free trial, you have access to the features of the selected plan at no charge. At the end of the trial period, your subscription automatically converts to a paid subscription unless you cancel before the trial ends. You will be charged the applicable subscription fee upon conversion. Free trial availability, duration, and included features may change at our discretion. Each user is eligible for one free trial only.

When using Momentum SaaS, you agree not to: - Scrape, crawl, or use automated tools to extract data from the platform - Redistribute, resell, or sublicense any data, scores, or content obtained from the service - Copy or reproduce momentum scores, charts, or analysis for commercial use without written authorization - Attempt to reverse-engineer the scoring algorithms or methodologies - Use the service to manipulate markets or engage in any activity that violates applicable securities laws - Interfere with or disrupt the service, servers, or networks connected to the platform - Create multiple accounts to circumvent usage limits or subscription restrictions - Share account credentials with third parties Violation of these obligations may result in immediate suspension or termination of your account.

All content, software, algorithms, designs, trademarks, and other intellectual property associated with Momentum SaaS are owned by or licensed to the service operator. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the service for personal, non-commercial purposes during your subscription period. The underlying market data used to calculate momentum scores is sourced from third-party data providers and is subject to their respective terms. You do not acquire any ownership rights to this data through your use of the service. User-generated content (such as portfolio configurations and alert settings) remains your property. By using the service, you grant us a limited license to process this content solely for the purpose of providing the service to you.

To the maximum extent permitted by applicable law, Momentum SaaS and its operator shall not be liable for: - Any investment losses or financial damages resulting from the use of or reliance on information provided by the service - Any indirect, incidental, special, consequential, or punitive damages - Any loss of profits, data, or business opportunities - Any damages arising from service interruptions, errors, or inaccuracies in the data Momentum scores are provided "as is" without any warranty of accuracy, completeness, or fitness for a particular purpose. The service does not guarantee that momentum scores will be error-free or that the data will be updated on any particular schedule. Nothing in these terms excludes or limits liability for matters that cannot be excluded or limited under applicable French law, including liability for intentional misconduct or gross negligence.

Momentum SaaS is provided on an "as available" basis. We do not guarantee any specific level of uptime, availability, or performance. The service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We will make reasonable efforts to minimize disruptions, but we are not liable for any downtime or service interruptions. We reserve the right to modify, suspend, or discontinue any feature or aspect of the service at any time, with or without notice. For significant changes affecting paid subscribers, we will provide reasonable advance notice.

You may terminate your account at any time through your account settings. Upon account termination: - Your access to the service is revoked immediately - Your subscription is cancelled (no further charges will be applied) - Your personal data is deleted in accordance with our Privacy Policy and applicable data protection law You may request a complete export of your data before deleting your account, in accordance with your rights under GDPR (right to data portability). We may suspend or terminate your account if you violate these Terms of Service, engage in fraudulent activity, or if required by law. In case of termination for cause, you are not entitled to a refund for the remaining subscription period. Following account deletion, we retain certain data as required by law (such as billing records) for the legally mandated retention period, after which it is permanently deleted.

These Terms of Service are governed by and construed in accordance with the laws of France. Any dispute arising from or relating to these terms or your use of the service shall be subject to the exclusive jurisdiction of the competent courts in France, without prejudice to any mandatory consumer protection provisions that may apply in your country of residence. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

We may update these Terms of Service from time to time. When we make material changes, we will notify you by email or through a prominent notice on the platform at least 30 days before the changes take effect. Your continued use of the service after the effective date of the updated terms constitutes your acceptance of the changes. If you do not agree with the updated terms, you may terminate your account before the changes take effect.
